Job description

IQVIA seeks an experienced attorney to serve as Assistant General Counsel, Healthcare Compliance and Investigations. Reporting to the SVP, Deputy General Counsel and Chief Compliance Officer, this attorney will provide expert advice and guidance to IQVIA on internal investigations, healthcare compliance, anti-bribery and anti-corruption (ABAC), fraud prevention, and compliance program effectiveness. The role requires deep subject matter expertise, sound judgment, strong executive presence and communications skills, and the ability to translate complex issues into practical, business-focused advice. The position will be based ideally in the U.S. Eastern time zone near one of IQVIA's locations in Durham, NC, King of Prussia, PA, Parsippany, NJ or Boston, MA, in which case it may be a hybrid role; a remote role will be considered. 


Key Responsibilities

Internal Investigations

  • Direct, support, and advise the Ethics and Compliance Office (ECO), Finance, Internal Audit (IA), Human Resources, and other stakeholders in privileged and confidential internal investigations; preserve attorney-client privilege and work-product protections.
  • Engage and manage outside counsel, forensic specialists, and other experts as appropriate; review investigation reports and remediation recommendations.
  • Maintain a regular cadence of investigation updates including as to investigations reported to the Audit Committee of the Board of Directors.
  • Guide investigators in identifying applicable laws, policies and standards; defining document review and interview strategies; clarifying ambiguities; and determining when sufficient information exists to reach conclusions and close a matter. Ensure preservation of relevant evidence, including O365 accounts and electronic records.
  • Evaluate legal, compliance, operational, and reputational risk; assess disclosure obligations.

Healthcare Compliance, ABAC, and Fraud and Abuse

  • Serve as a principal legal subject matter expert on the FCPA, U.S. Anti-Kickback Statute, False Claims Act, UK Bribery Act, healthcare fraud and abuse requirements, other global ABAC laws, and government expectations for effective corporate compliance programs.
  • Advise on interactions with healthcare professionals and healthcare organizations, including consulting arrangements, advisory boards, market research, grants, sponsorships, investigator relationships, and other business activities.
  • Identify and mitigate bribery, kickback, fraud, and third-party risks, and support responses to regulatory inquiries, audits, investigations, and other compliance reviews.

Compliance Program and Strategic Support

  • Advise on policy development and updates, training and communications, program governance, controls, monitoring and risk assessments, including reviews of interactions with health care providers such as primary market research efforts, data procurement, patient support programs, and other higher-risk activities.
  • Support reviews of IQVIA’s government official gating process for candidates, including as to escalations from regional lawyers and updates to the process and related controls.
  • Advise M&A lawyers on escalated ABAC, healthcare compliance, fraud and ethics red flags identified during pre-acquisition diligence; assess recommendations from outside counsel, and support risk mitigation and integration planning.
  • Provide legal guidance on vendor ABAC due diligence escalations and third-party risk remediation, including government affiliations, HCP relationships, conflicts of interest, and potential corruption concerns.

Additional Responsibilities

  • Advise regional lawyers and contract managers on IQVIA ABAC and healthcare compliance requirements in customer, vendor, and other third-party agreements.
  • Participate in regular meetings and governance processes regarding applicable operational efforts
  • Serve as a trusted advisor on the IQVIA Code of Conduct, corporate policies, emerging compliance risks, remediation and pragmatic solutions that appropriately balance legal, compliance and business considerations.

Qualifications

  • Juris Doctor from an accredited law school and active license to practice in at least one U.S. jurisdiction.
  • Generally 10+ years of relevant experience in a law firm, corporate legal department, government agency, or compliance function, including significant responsibility for internal investigations and healthcare or corporate compliance matters.
  • Substantial experience advising senior stakeholders and working across Legal, Compliance, HR, IA, Finance and business functions in a complex organization.
  • Life sciences, healthcare services, CRO, pharmaceutical, med tech, or related industry experience strongly preferred.
  • Experience working in a global organization, including directing internal investigations across multiple countries and regulatory environments.

Required Subject Matter Expertise

  • FCPA, U.S. Anti-Kickback Statute, False Claims Act, global ABAC laws, healthcare fraud and abuse requirements, and HCP/HCO engagement compliance.
  • Government enforcement priorities and standards for effective corporate compliance programs; internal investigations, remediation, third-party due diligence and M&A compliance risk assessment.
  • ABAC and healthcare compliance risk areas, including vendor relationships, HCP interactions, patient support programs, market research, GO Gating and mergers and acquisitions.
  • Knowledge of corporate policies and financial systems, concepts, and controls including the codes of conduct, revenue recognition, travel and expense policies, procurement processes, engagements with government officials and health care providers

The potential base pay range for this role, when annualized, is $145,400.00 - $405,000.00. The actual base pay offered may vary based on a number of factors including job-related qualifications such as knowledge, skills, education, and experience; location; and/or schedule (full or part-time). Dependent on the position offered, incentive plans, bonuses, and/or other forms of compensation may be offered, in addition to a range of health and welfare and/or other benefits.
