Terms of Use – Jobgether

1. General information

1.1 Scope of application

JOBGETHER is a limited liability company (SRL) legally constituted and existing under Belgian law, with its registered office in Belgium at 1180 Uccle (Brussels), avenue du Prince de Ligne, n° 91/box 3, registered with the Crossroads Bank for Enterprises in Belgium under number 0726.964.817, and entered in the Brussels Register of Legal Persons (hereafter referred to as "Jobgether", "we", "us" or "our").

These general terms and conditions of use (the "Terms of Use") determine the conditions of access to and use of our website (the "Site") and of the platform operated and owned by Jobgether, including all features and services available through it, accessible in Software-as-a-Service (SaaS) mode (the "Platform"), by any natural person seeking remote, hybrid or flexible professional opportunities (the "Talent", "User", "you", "your" or "yours").

"Company" means any employer, recruiter or other organisation offering job opportunities, whether or not it has a contractual relationship with Jobgether. Companies are not Users of the Platform under these Terms of Use.

Jobgether and Users may hereinafter be referred to together as the "Parties" or individually as a "Party".

By accessing and using the Platform, you warrant that you are a natural person of at least eighteen (18) years of age. If you are not, you must not access or use the Platform. Jobgether reserves the right to request that you provide proof, by any means, that you meet the minimum age requirement.

Jobgether operates a global career platform for remote and hybrid work. Through the Platform, we (i) aggregate and display job opportunities collected from publicly available third-party sources or published by Companies, (ii) provide AI-assisted matching, scoring and feedback between your Profile and job opportunities, (iii) offer career tools such as CV and profile reviews and, (iv) for Premium subscribers, the additional services described in Section 6. Jobgether does not act as an employer, recruitment agency or employment intermediary and is not a party to any recruitment process, selection decision or employment contract between you and a Company.

1.2 Acceptance

When you register on our Platform (see Section 2), we ask you to confirm that you have read and accepted these Terms of Use, by checking the box provided for this purpose.

This acceptance is final and without reservation, and extends to the other legal documents we make available on our Platform, including our Privacy Policy. If you do not agree with the contents of these Terms of Use, you must not access or use our Platform.

1.3 Modification

We reserve the right to modify these Terms of Use from time to time. If we do so, we will update the date on which the latest changes were made. This date appears at the top of our Terms of Use, accessible via the dedicated link at the bottom of each page of our Site and Platform.

Should there be any significant changes that may negatively impact the use of our Platform, we will actively inform you of the changes, for example by posting a notice on the Platform or by sending you an email to the email address associated with your Account.

Unless otherwise stated, any changes made are effective immediately. If you continue to access and use our Platform, you are deemed to have accepted the new Terms of Use. If you do not agree with the changes, you are free to delete your Account at any time (see Section 3).

1.4 Contact

If you have any questions, comments or complaints about the Platform, its content or its use, or about these Terms of Use, please contact us by e-mail at support@jobgether.com or send us a letter to the postal address above. We will do our best to answer you as soon as possible.

Should we need to contact you, we will use the e-mail address you provided when you registered on the Platform or that you later updated in your Personal Space.

We thank you for your visit and recommend that you read these Terms of Use carefully before accessing and using our Platform.

2. Access to and registration on the Platform

2.1 Access to the Platform

To access the Platform for the first time, you must register by creating a personal account (the "Account"). Signing up on the Platform is free.

You may create or access your Account with a login and password, or through a third-party authentication service (such as Google or LinkedIn). If you use such a service, its terms apply in addition to these Terms of Use.

2.2 Registration on the Platform

When you create your Account, you will be asked to provide your first and last name and your email address, and, where applicable, to choose a password.

To build your profile (the "Profile") and improve the relevance of your matches, you may also be asked to provide additional information such as your CV, work experience, skills, location and job preferences.

You are required to provide true, accurate, complete and up-to-date information, and to keep it up to date. You can update this information at any time via your personal space on the Platform (the "Personal Space").

Your login and password are strictly personal. When creating your Account, you are strictly forbidden to impersonate any other person for the purpose of accessing and using our Platform. You must maintain the confidentiality of your Account, your login and your password, and inform us without delay at support@jobgether.com of any use or risk of unauthorised use of your Account. Jobgether reserves the right to take, in these circumstances, all necessary measures to stop the usurpation.

Each User may only have one Account on the Platform. You are strictly prohibited from assigning or transferring, in any manner whatsoever, your Account to a third party.

2.3 Verification of your Profile

Jobgether may, but is not obliged to, verify the information entered in your Profile, and may request any document from you to verify the accuracy of that information.

Jobgether reserves the right to refuse or suspend your registration on the Platform at its sole discretion, in particular if you refuse to share a document that verifies the accuracy of the information provided in your Profile.

3. End of access

You are free to delete your Account at any time by visiting the dedicated page in your Personal Space. This deletion is irreversible. Deleting your Account ends any active Premium Subscription at the end of the current billing period, without refund of the remaining period, except as provided in Section 6.6 or by mandatory law.

We reserve the right to suspend or delete your Account at any time and at our sole discretion, including but not limited to (i) if you fail to provide us with the information necessary to verify the accuracy of the information provided via your Profile, (ii) in case of breach of these Terms of Use, or more generally (iii) in case of failure to comply with applicable laws and regulations.

We also reserve the right to terminate access to the Platform at any time should we decide not to continue operating the Platform. In this case, you will be informed of the deletion of your Account by e-mail with at least three (3) months' notice before access to the Platform is permanently discontinued. You must take, within this period, all the necessary measures to safeguard the data you wish to keep. The cessation of the Platform will not give rise to any compensation on the part of Jobgether, other than the pro rata refund of any prepaid Premium Subscription period not yet used.

4. Content made available via the Platform

4.1 Your responsibility

As a User of our Platform, you are solely responsible for the information you communicate and the content you publish through the Platform and, more generally, for all the elements you make available via our Platform (the "Content").

4.2 Licence on your Content

By submitting Content (including your CV, Profile information and application materials), you grant Jobgether a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, analyse (including by automated and AI-based means), adapt for formatting purposes and transmit such Content, to the extent necessary to operate the Platform and provide the services you request, including transmitting your application materials to Companies and their recruitment systems. You warrant that you hold the rights necessary to grant this licence. This licence ends when you delete the Content or your Account, subject to legal retention obligations.

4.3 Sharing your Profile with Companies

Jobgether transmits your Profile, CV or contact details to a Company only (i) in the context of an application you have initiated or that AI Auto-Apply has submitted on your behalf (see Section 6.3), or (ii) if you have given your explicit consent to Jobgether sharing your Profile with Companies or recruiters looking for candidates. You may withdraw this consent at any time in your Personal Space or by contacting us at support@jobgether.com; withdrawal does not affect sharing that took place before it.

4.4 Prohibited Content

When using our Platform, you agree to comply with all applicable laws and regulations. In particular, you agree not to publish, upload, post or transmit any Content (non-exhaustive list):

  • contrary to public order or morality;
  • infringing;
  • fraudulent, false or misleading;
  • abusive, defamatory, insulting, denigrating, slanderous, vulgar, obscene, shocking, pornographic, paedophilic;
  • of a discriminatory, racist, intolerant, hateful nature or that encourages hatred or harassment of an individual or group of individuals;
  • threatening, abusive, violent or that encourages violence;
  • advocating crimes or offences;
  • violating the rights of others and, in particular, likely to harm the dignity, honour or reputation of an individual;
  • undermining the protection of minors;
  • encouraging illegal or dangerous activities or substances.

4.5 Your undertakings

You also agree to (non-exhaustive list):

  • protect your own data and/or software stored on your computer equipment from potential harm when using the Platform (viruses, Trojan horses or other malware);
  • comply with any instructions we may give you in connection with our Platform and its use (for example, in the event of maintenance work on the Platform);
  • refrain from copying and/or misappropriating for your own purposes or those of third parties the concept, technologies or any other element of our Platform;
  • refrain from any practice that seeks to use the Platform for purposes other than those for which it was designed;
  • refrain from accessing the Platform or extracting its content by automated means (bots, scrapers, crawlers) and from using Platform content to train, fine-tune or operate machine-learning models;
  • refrain from any action that imposes a disproportionate burden on the Platform's infrastructure and from any behaviour that may affect the proper functioning of our Platform;
  • refrain from selling, monetising or conceding to a third party all or part of the access to the Platform or the information contained therein; and, more generally,
  • refrain from violating these Terms of Use, as well as applicable laws and regulations.

Should you fail to comply with any of the foregoing commitments or, more generally, should you violate applicable laws and regulations, we reserve the right to take all appropriate measures and, if necessary, to take any legal action necessary to preserve and defend our rights and interests.

5. Job opportunities and third-party sources

Job opportunities displayed on the Platform originate in whole or in part from third-party sources (company career pages, applicant tracking systems, job boards) or are published by Companies. Jobgether does not guarantee that such opportunities are accurate, complete, still open, or that the Company concerned is bound by them, and may remove or modify any opportunity at any time.

When you apply to an opportunity, you may be redirected to a third-party website governed by its own terms and privacy policy, or your application may be transmitted to the Company's recruitment systems. From that moment, the processing of your application is under the sole control of the Company.

Jobgether is not a party to any recruitment process, selection decision or employment contract between you and a Company, and is not responsible for the conduct of Companies or for the outcome of any application.

6. Premium Subscription

6.1 Free access and Premium Subscription

Access to the Platform and its core features (job search, match insights and a first CV review) is free of charge. Jobgether also offers a paid subscription (the "Premium Subscription") giving access to additional features (the "Premium Features"). By subscribing, you acknowledge and agree to the terms set out in this Section 6.

6.2 Premium Features

Depending on the plan selected, the Premium Features may include:

  • AI Auto-Apply, through which Jobgether prepares and submits applications on your behalf (see Section 6.3);
  • advanced matching features such as Company Match and Top Match;
  • AI reviews and optimisation of your CV and LinkedIn profile;
  • AI match score and feedback on job opportunities;
  • career-coaching tools (Career Coach, contact hiring manager, hidden job market, career and market assessments).

The exact features included in each plan are those described on the subscription page at the time of purchase. The availability of Premium Features may evolve; where a change materially reduces the value of your plan, Section 1.3 applies.

6.3 AI Auto-Apply

When you activate AI Auto-Apply, you expressly authorise Jobgether to complete and submit applications in your name, using the information in your Profile and Content, to the opportunities you have selected or that match the criteria you have set. You remain solely responsible for the accuracy of that information and for every application submitted on your behalf. You may deactivate AI Auto-Apply at any time; applications already submitted cannot be withdrawn by Jobgether. Jobgether does not guarantee that any application will be received, considered or answered by the Company.

6.4 AI-generated content

Match scores, feedback, CV and profile reviews and other outputs generated by artificial intelligence are indicative only, may contain errors and do not constitute professional, legal or career advice. You should review AI-generated content before relying on it or sending it to a third party. Jobgether's principles for the use of AI are described in its AI Charter, available on the Site.

6.5 Plans, fees and renewal

The Premium Subscription is offered as a monthly, quarterly or yearly plan. The applicable fee, currency and payment methods are displayed during the subscription process. Payments are processed by our payment provider, Stripe; you must provide a valid payment method and keep it up to date.

Each plan renews automatically for a period of the same length and is billed in advance at the start of each period, unless you cancel before the renewal date as described in Section 6.7. Any change to the subscription fee will be notified to you by e-mail at least thirty (30) days before it applies to your next renewal; you may cancel before that date if you do not accept the new fee.

6.6 Right of withdrawal

You have the right to withdraw from your Premium Subscription, without giving any reason, within fourteen (14) days of the day on which you first subscribed. To exercise this right, send an e-mail to support@jobgether.com from the e-mail address associated with your Account, stating that you wish to withdraw. We will refund the amount paid, using the same payment method, no later than fourteen (14) days after receiving your request.

The right of withdrawal applies to the initial subscription only, not to subsequent renewals. Except as provided in this Section 6.6, in Section 6.8 or by mandatory law, subscription fees are non-refundable and no refund is granted for partial subscription periods.

6.7 Cancellation and plan changes

You may cancel your Premium Subscription or change your plan at any time from your Account on the Platform, which will redirect you to your subscription management page. Cancellation takes effect at the end of the current subscription period; you keep access to the Premium Features until then.

6.8 Suspension or termination by Jobgether

Jobgether reserves the right to suspend or terminate a Premium Subscription in case of violation of these Terms of Use, without refund. Should Jobgether terminate a Premium Subscription for any other reason, the unused portion of the current subscription period will be refunded pro rata.

6.9 Personal data

Personal data processed in connection with the Premium Subscription is processed as described in our Privacy Policy.

6.10 No guarantee of outcome

The Premium Features are provided on a best-effort basis. Jobgether does not guarantee job placement, interviews or any other outcome as a result of using the Premium Features.

7. Warranties and limitation of liability

We are committed to providing information that is as accurate and correct as possible, but we do not guarantee the accuracy, completeness, reliability or suitability of all information and content made available to you on our Platform, and we cannot accept any liability for this. This applies both to information and content published on the Platform by us and to information and content published by you or, where applicable, by third parties. The terms "information" and "content" refer to all elements that may be made available on the Platform, including but not limited to texts, images, sounds or data.

We shall not be liable for any damage or defect, whether permanent or temporary, to your computer equipment or data, incurred or caused in the course of or following the use of the Platform. In particular, we shall not be liable for the transmission of any viruses, Trojan horses or other malicious programs via the Platform.

We cannot be held responsible for any hyperlinks that may be found on the Platform and that refer to websites operated by third parties, nor for any damage that may be caused to your devices when you visit these sites. We have no control over these sites and cannot be held responsible for the information and content published on them.

We use up-to-date technology as far as possible in the creation and operation of the Platform and carry out regular checks to ensure that it is accessible and functioning properly. However, we cannot be held responsible for any (temporary) breakdowns, interruptions or failures of the Platform or for any difficulties encountered due to maintenance work being carried out on it.

We cannot be held responsible for any decision made or action taken by you based on the information and content published on the Platform, nor for any damage, direct or indirect, that may result from the inaccuracy, incompleteness, irrelevance or omission of such information and content, or from your interpretation of it.

More generally, we cannot be held liable for damages resulting from any violation of these Terms of Use by you or from your failure to comply with applicable laws and regulations.

Nothing in these Terms of Use excludes or limits Jobgether's liability for its intentional fault or gross negligence, or any liability that cannot be excluded or limited under mandatory law, including consumer protection law.

8. Indemnification

You agree, to the extent permitted by applicable law, to indemnify, hold harmless and defend Jobgether from and against any and all claims, losses, costs, liabilities or damages relating to or arising from:

  • the Content you make available on the Platform;
  • the violation of third-party rights, in particular intellectual property rights;
  • the violation of any of the provisions of these Terms of Use; and, more generally,
  • the violation of any laws and regulations that may apply as a result of your use of the Platform.

9. Intellectual property

All elements of the Platform, including but not limited to the systems and software used, the source code, the object code, the layout of the elements on the Platform, the IT infrastructure, the databases and content of any kind (including texts, images, visuals, photographs, sounds, logos, the name "Jobgether", trade names, trademarks and domain names), are protected by copyright and/or other intellectual property rights.

All applicable intellectual property rights (copyright, trademark rights, database producer rights, design rights, patent rights, etc.) are and remain the property of Jobgether or have been incorporated into the Platform with the authorisation of the owner of the rights in question.

You may not store or record (except to the extent necessary for the use of the Platform), reproduce, modify, translate, disseminate to the public, distribute, rent, sell or transfer to third parties any of the elements of the Platform or any of the data or information made available on the Platform, nor use them in any way without our prior written authorisation.

All acts of extraction, data mining, scraping and similar acts with respect to the elements (or certain elements) of the Platform are strictly prohibited.

10. Protection of personal data

We process and store the personal data we collect when you visit and use the Platform:

  • in compliance with the laws and regulations in force applicable to the processing of personal data, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR) and the Belgian law of 30 July 2018 on the protection of individuals with regard to the processing of personal data; and
  • in accordance with our Privacy Policy.

Companies that receive your personal data through the Platform (for example when you apply to an opportunity or when your Profile is shared with your consent) act as independent data controllers for their own recruitment purposes. We therefore strongly recommend that you consult the privacy policy of the Companies with which you come into contact via our Platform.

The term "personal data" has the meaning given in Article 4(1) of the GDPR.

11. Miscellaneous provisions

Jobgether's failure to enforce or take any action against you for breach of any provision of these Terms of Use shall not be deemed a waiver of its right to enforce or take action for any subsequent breach of such provision.

Should any of the provisions of these Terms of Use be invalid, this shall not affect the binding nature of the other provisions. The Parties agree that provisions deemed invalid and/or unenforceable by a competent judicial or administrative authority shall be replaced by conforming provisions that are as close as possible to the provisions deemed invalid and/or unenforceable and of equivalent economic effect.

Should any inconsistency or dispute arise with respect to the interpretation of any term or provision contained in any translation of these Terms of Use, the English version of the Terms of Use shall prevail.

12. Jurisdiction – Applicable law

These Terms of Use shall be exclusively governed by and construed in accordance with Belgian law.

Any dispute relating to these Terms of Use, in particular concerning their validity, interpretation or performance, and more generally any dispute between the Parties, shall be submitted to the exclusive jurisdiction of the courts of Brussels, unless mandatory legal provisions provide otherwise.

Before taking legal action, the Parties shall take all reasonable steps to reach an amicable solution to the dispute between them. If you are a consumer, you may also submit the dispute to the Belgian Consumer Mediation Service (Service de Médiation pour le Consommateur / Consumentenombudsdienst).
