Commercial, Business & Real Property Litigation Attorney

Remote | Must reside in and travel within South Florida | $50 - $100 per hour | Part Time 


Mayersohn Law Group, P.A. is seeking an experienced Commercial, Business & Real Property Litigation Attorney to support an active docket of contract, business, partition, constructive-trust, and related civil disputes.

This role is primarily remote, with occasional in-person appearances, depositions, mediations, hearings, client meetings, or trial-related work in South Florida. The ideal candidate is an independent, strategic Florida litigator who can manage sophisticated civil matters from early case assessment through resolution while maintaining excellent client communication, case organization, and litigation judgment.

Core practice areas

This position will support matters involving:

  • Contract disputes and breach-of-contract claims
  • Business and commercial disputes
  • Partnership, shareholder, member, and ownership conflicts
  • Real-property disputes, including partition actions
  • Constructive trusts, equitable liens, unjust enrichment, and other equitable remedies
  • Multi-party civil disputes involving damages, ownership, business relationships, or property interests
  • Pre-suit disputes, negotiated resolutions, mediations, and contested litigation

Key responsibilities

  • Independently manage assigned commercial, business, and real-property litigation matters from intake through resolution.
  • Evaluate claims, defenses, damages, remedies, evidentiary issues, and litigation risk.
  • Draft and revise pleadings, motions, memoranda, discovery requests, discovery responses, subpoenas, and settlement-related documents.
  • Develop case strategy, discovery plans, deposition outlines, and hearing or trial-preparation plans aligned with client objectives.
  • Conduct legal research and prepare clear, persuasive written analysis regarding contract, business, property, and equitable claims.
  • Take and defend depositions; prepare clients, witnesses, and experts for depositions, hearings, mediations, and trial.
  • Handle motion practice, hearings, mediations, settlement negotiations, and other litigation proceedings, as assigned.
  • Coordinate factual investigation, document collection, discovery, expert analysis, and damages support.
  • Communicate professionally and strategically with clients, opposing counsel, court personnel, experts, and firm team members.
  • Maintain accurate case records, deadlines, task lists, time entries, and documentation in the firm's case-management systems.
  • Collaborate with supervising attorneys, paralegals, legal assistants, and outside professionals to move matters forward efficiently.
  • Meet agreed-upon billable, responsiveness, and work-product expectations.

Qualifications

  • Juris Doctor from an accredited law school.
  • Active membership in good standing with The Florida Bar.
  • At least five years of substantive litigation experience in commercial, business, real-property, or complex civil matters.
  • Demonstrated experience handling contract disputes, business conflicts, partition actions, constructive-trust claims, and/or related equitable remedies.
  • Strong experience drafting dispositive and non-dispositive motions, discovery, written discovery responses, legal memoranda, and settlement documents.
  • Experience conducting or substantively preparing for depositions, evidentiary hearings, mediations, and trial.
  • Ability to assess facts, legal theories, damages, leverage, and litigation risk independently.
  • Excellent legal writing, oral advocacy, negotiation, and client-communication skills.
  • Strong organization, deadline management, billing discipline, and attention to detail.
  • Ability to work independently in a remote environment while remaining responsive, accountable, and collaborative.
  • Ability to travel occasionally for proceedings and firm-related needs within South Florida.

Preferred

  • Experience litigating partnership, shareholder, LLC-member, fiduciary-duty, ownership, or business-breakup disputes.
  • Experience with equitable remedies, including constructive trusts, equitable liens, injunctions, receiverships, or declaratory relief.
  • Experience coordinating experts, damages analyses, financial records, property records, or multi-party discovery.
  • Familiarity with Florida state-court practice, including e-filing, local procedures, and civil-motion practice.
  • Experience using Clio, LexisNexis, Microsoft Office, and remote collaboration tools.
  • Previous contract-attorney, hybrid, or remote litigation experience.
