Responsibilities:

Detailed Job Duties
• Attend hearings, trials, and depositions on behalf of the company and its clients.
• Provide testimony on contested and non-contested matters, including but not limited to late-stage default processes, foreclosures, evictions, unlawful detainers, bankruptcy as well as corporate legal matters.
• Act as Corporate Representative including but not limited to a Federal Rule of Civil Procedure Rule 30(b)(6) witness for the company and its clients.
• Effectively participate in court ordered conferences and mediations.
• Actively participate in the negotiation of settlement and resolution of matters.
• Prepare judgment figures, as well as corporate advance and escrow breakdowns as well as other accounting or auditing of a file as necessary.
• Effectively communicate with clients as to status of litigation and other matters as necessary.
• Recognize and make recommendations to facilitate the appropriate course of action to mitigate exposure for the company and its clients.
• Review pleadings, loan file and servicing records in preparation for meetings, mediations, or other appearances.
• Support in-house counsel, on research projects regarding servicing issues and pre-litigation consumer disputes.
• Work with business partners to obtain documents and information necessary to provide accurate and relevant answers to discovery and testimony.
• Provide training on best practices as a corporate witness. Coordinate trainings with outside counsel, in house counsel and operations.
• Develop and facilitate on-going training and support to Foreclosure and mediation witnesses.
• Travel as required to multiple locations to provide testimony. Travel may exceed 60% of working hours.

Qualifications:

Minimum Qualifications
• High School Diploma or equivalent required. Bachelor’s degree strongly preferred; 5+ years of relevant career experience will be considered in lieu of a degree.
• 5+ years mortgage servicing experience, including but not limited to loss mitigation, default, and foreclosure.
• Previous experience working with attorneys and negotiating settlements.
• Previous experience in monitoring activity of multiple files assigned to outside counsel.
• Prior witness experience either for deposition or trial is a must.
• Knowledge of FHA, FNMA and FHLMC servicing guidelines, including default guidelines.
• Knowledge in agency, investor or insurer timelines.
• Strong professional and interpersonal communication skills.
• Strong computer skills, including strong skills and experience in TEAMS, Zoom, Microsoft Excel, Word, and Outlook.
• Firm comprehension of loan servicing guidelines and procedures.
• Experience with FiServ, MSP, Loansphere or other mortgage platforms.
• Excellent verbal and written communication skills.
• Ability to multi-task, organize, prioritize, research, and resolve issues in a timely and effective manner.
• Ability to meet strict deadlines and take direction.
• Must be able to provide clear, concise written responses to management inquires.
• Advanced professional analytical skills, ability to analyze problems and provide the appropriate solution.
• Advanced problem solving, multi-tasking and organizational skills with strong attention to detail.
• Proven ability to prioritize workflow during high volumes within a critical time frame.

Work Conditions 

Able to attend work and be productive during normal business hours and to work early, late or weekend hours as needed for successful job performance. Overtime required as necessary.
