Regulatory Counsel
We are looking for a Product Regulatory Counsel who will serve as a key member of athenahealth’s legal team. Reporting to the Associate General Counsel – Product and Regulatory Compliance, the Product Regulatory Counsel will oversee a wide range of regulatory and compliance work concerning the governance and exchange of health information and the provision of athenahealth’s services and internal business practices. In this role, the Regulatory Counsel will work closely with our product, sales, marketing, and business development teams, but will collaborate with almost every function at the Company as we strive to improve the quality of care, reduce clinician burnout, and build a modern, connected healthcare ecosystem.
Team Summary: The legal team at athenahealth is dedicated to ensuring compliance with healthcare regulations and supporting the organization in delivering innovative healthcare solutions while mitigating legal risks.
Job Responsibilities
Counsel the business on laws and regulations impacting our customers’ delivery of clinical services, including privacy and security matters, payment rules, and quality program reporting.
Educate internal stakeholders on relevant risk-management issues and advise on the implementation of effective compliance programming.
Consult with the business and appliable stakeholders on matters relevant to key healthcare compliance laws and regulations, including but not limited to, HIPAA, the Federal False Claims Act, participation in federally funded value-based care programs, regulations related to the certification of electronic health record technologies, and related state laws.
Review and interpret federal rulemaking and other guidance from government agencies (e.g., CMS, ASTP/ONC, and OIG) and design and implement compliance programs based on the regulatory guidance.
Perform research into emerging regulatory changes and case law; anticipate and develop responses to regulators regarding compliance issues and other inquiries.
Independently investigate and act on compliance issues to successful resolution, including internal investigations and any resulting corrective actions.
Proactively monitor policy developments relevant to health care technology products and services.
Typical Qualifications
3+ years of regulatory legal experience at a healthcare or technology company, a mid to large-sized law firm, and/or in government
J.D. from a well-recognized law school and excellent academic credentials
Admitted to a U.S. state bar in good standing
Experience providing legal and strategic guidance to clients, including organizational leadership, on risk assessment and mitigation in support of strategic initiatives is highly desirable.
Experience working on the privacy and data protection aspects of product development in the health care and/or technology spaces.
Experience drafting organizational policies and procedures related to healthcare regulations.
Broad-based healthcare compliance programming experience, or HCCA certification, is a plus.
Familiarity with Medicare reimbursement, audit, and billing requirements a plus.
