ATTORNEYS' TITLE FUND SERVICES

Purpose of Position:

Search and examine statewide, complex commercial properties from buy/sell to closing of transaction, including lending. Build and maintain relationships with Fund Members in order to assist in the growth of Fund Member’s commercial real estate business.

*Florida title examination required

*Prefer to be located in Central Florida but will consider remote in the state of Florida only.

Primary Responsibilities:

  • Review order to ensure that the information and material provided is sufficient to frame the transaction as submitted to meet the Fund Member’s needs and transactional requirements are understood, including if there are any considerations the Fund Member or The Fund should contemplate in order to consider the risk. 
  • Review order to identify the exact nature of any financing arrangement.  Familiarity with loan policies is essential, which requires an understanding of the issuance of a new policy, an endorsement to an existing policy, or stacked coverage. 
  • Search computerized and manual title information property records and determine instruments filed in public records affecting commercial property.
  • Thorough review to ensure base title information is within The Fund’s guidelines.
  • Review legal descriptions, enlisting complex mapping skills to eliminate exceptions that do not apply.  Identify complex property boundaries and ensure the contract legal description and the record title legal description match.
  • Determine and ensure property has been researched properly and information relating to parties involved, including taxes, are accurate, noting any discrepancies.
  • Examine all documents in chain of title to confirm validity, adverse circumstances, and any necessary corrective action, including multiple and complex court cases, by utilizing advanced knowledge of legal descriptions, real property laws, and The Fund’s Title Notes.
  • Perform research within the context of search and examination of real property. Interpret and apply laws accordingly. Determine how apparent title is vested and what qualifies as an outstanding lien and/or encumbrance.
  • Examine easements to determine if the easement benefits insured fee simple parcel(s) or if the easement burdens fee simple parcel(s) by third party. Ability to analyze beneficial easements that may be added to the insured legal and proactively discuss with Fund Member as soon as practical.
  • The ability, after title is examined, to determine that an order requires underwriting guidance to progress the order. Work directly with Fund Underwriting Counsel and Fund Member for guidance and/or approval.
  • Review survey legal descriptions and drawings for accuracy. Read complex surveys to appropriately draft a specific survey exception and spot issues, including but not limited to, determining any encroachments, any ALTA 9 issues, or access issues.
  • Organize title information; analyze, describe, and make requirements to correct errors, and ensure the proper documentation of research evidence and outline of chain.
  • Properly and thoroughly complete forms necessary to communicate issues related to the transaction to Fund Underwriting Counsel.
  • Evaluate objection letters from Lender’s counsel or other outside counsel and discuss said objections with Fund Underwriting Counsel and/or Fund Member as necessary.
  • Effectively communicate with internal and external customers to answer inquiries, solve issues, and discuss findings and documentation needed. 
  • Agility in processing reworks on files with accuracy and precision in tight timeframes.
  • Prepare commitments, pro forma policies, and endorsements for commercial transactions.
  • Prepare final policies and endorsements, Construction Loan Update Endorsements and Form E Policy Endorsements.
  • Participate in peer quality assurance review of examined products, pro forma policies, and final policies, prior to delivery to Fund Member.
  • Mentor and train Senior Examiners in handling complex commercial transactions.

Education: High school diploma or equivalent

Experience:

  • Four years’ experience as a Senior level Title Examiner.
  • Experience working with commercial transactions and commercial projects preferred.

Knowledge/Skills/Abilities:

  • Knowledge of the title insurance and information industry is required
  • Knowledge of The Fund’s customer facing applications (ResWare or ATIDS XE) is preferred
