Commercial Manager

The role

The Commercial Manager performs end to end commercial management of our largest customers throughout various stages of the contract lifecycle, including

  • In-Life - optimising the commercial performance of the contract including large scale change; managing and resolving commercial disputes; driving margin and revenue improvement activities and looking at ways to increase efficiency
  • Contract extension or renewal - securing timely renewal of the contract whilst minimising erosion of revenue and margin
  • The Commercial Manager will work collaboratively with many different areas of the Business including Delivery, Product, Legal, Finance and Technology, providing commercial thought leadership and decision making; and to work directly with our customers and supplier management teams.
  • The role would suit candidates who have a demonstrable ability to understand and manage a variety of complex commercial and contractual models; use available data and appropriate judgements leading to informed decisions; negotiate pragmatically at all levels in an organisation; draft contract changes, mitigate contractual risk, and identify and create value from challenging commercial issues

Change

  • Commercial qualification of new opportunities identified by the Account team
  • Commercial strategy for successfully accepting change with optimal commercial KPIs
  • Ensure that the change process is correctly followed and governance requirements met
  • Assisting the supplier management teams with the negotiation of goods/services to provide robust solutions to customer requests
  • Securing appropriate governance approval and buy in from supporting business functions
  • Drafting a range of change notes, including complex, high value changes

Contract Compliance

  • Ensure agreed commercial terms are accurately and clearly captured in Contract Change notes, including that appropriate risk mitigations have been identified
  • Ensure commercial contractual obligations and liabilities are clearly documented and handed over to appropriate teams involved in delivery/execution of contract
  • Ensure risk mitigation measures are understood and monitored / implemented

In-Life

  • Contract Management including tracking of obligations, deliverables and supporting documentation including the contract conformation, asset register, audit and other documents that sit beneath the contract.
  • Drafting of contractual documents with minimal support from Legal
  • Effecting contract extensions, renewals and terminations
  • Facilitation/co-ordination of commercial contract governance boards (as required)
  • Management of commercial disputes to mutually satisfactory outcome for Arqiva and our customers
  • Ensure cost models are adhered to throughout contract lifecycle
  • Proactively seek and then drive incremental revenue and margin activities through revenue growth and/or cost reduction

The person

  • Minimum of 5 years’ experience in Commercial and Contract Management
  • Proven leadership working with customers, internally and externally, and a strong appreciation of sales processes and methodologies
  • Consistent delivery of exceptional results through matrix team structures
  • Strong decision making with the ability to balance conflicting priorities
  • Proven highly complex negotiation skills with internal and external customers including dispute management
  • Strong risk management skills, able to identify most appropriate mitigation actions to reduce exposure
  • Excellent communications at all levels and the ability to simplify complexity
