TOR:  Legal Consultant to Conduct Legislative Analysis on Technology-Facilitated Gender-Based Violence (TFGBV) in Kenya (Short-term opportunity)

About IREX: IREX is an independent nonprofit organization dedicated to building a more just, prosperous, and inclusive world by empowering youth, cultivating leaders, strengthening institutions, and extending access to quality education and information. 
The National Models for Women's Safety Online (NMWSO) program aims to document, test, and advance system-level responses to prevent Technology-Facilitated Gender-Based Violence (TFGBV) through the engagement of public and private sector actors in Kenya and the Philippines.
Summary of Responsibilities
IREX seeks a qualified legal consultant based in Kenya to conduct an assessment of the legislative and regulatory frameworks governing digital engagement and online spaces, with a focus on Technology Facilitated Gender Based Violence (TFGBV). The consultant will review existing laws, policies and frameworks to identify gaps, challenges, and opportunities to strengthen protection against TFGBV in Kenya
Please note this position is part-time and based on the needs of the project, with an expected engagement of 10 days of effort distributed across December 2024-January 2025. The chosen consultant will work remotely.
Your Anticipated Tasks
The research consultant will perform the following tasks in Kenya.
  • Conduct a desk review of Kenyan laws, policies, and regulations addressing TFGBV and digital engagement, including but not limited to the Sexual Offenses Act and Data Protection Act.
  • Analyze the alignment of Kenyan legislation with regional and international frameworks addressing TFGBV.
  • Document enforcement mechanisms, regulatory structures, and judicial practices relevant to TFGBV in Kenya.
  • Identify gaps, challenges and recommendations in the legislative and regulatory environment, including implementation and enforcement barriers.
  • Draft a detailed report documenting the findings (mapping of relevant legislation and regulations and analysis thereof).
 
Deliverables  
  • Deliverable 1: Research plan outlining the methodology, scope, and timeline for the legislative and regulatory review
  • Deliverables 2: Results of legislative/regulatory mapping and draft report summarizing findings on Kenya’s legislative and regulatory framework for TFGBV, including gaps and challenges.
  • Deliverables 3: Finalized report incorporating feedback from IREX and the NMWSO team, with actionable recommendations for improving the legislative and regulatory environment.
 
Your Background & Skills
  • Bachelor’s degree in law, public policy, gender or women’s studies, international development, social science, or another relevant field, advanced degree preferred.
  • Proven track record of conducting legal analyses and legislative reviews, especially on gender-based violence or digital rights in Kenya.
  • Ability to analyze and synthesize complex legal documents and policies.
  • Experience upholding high ethical standards in research
  • At least three (3) years’ experience conducting research
  • Excellent written and oral command of English.
  • Physically based in Kenya.
