Topcon is seeking an attorney to join a small and efficient legal group helping the Eye Care Business in the United States and to a lesser extent, world-wide.  It is a fantastic opportunity to join a growing technology business that serves important societal needs.  Due to the diverse nature of Topcon’s businesses and world-wide footprint, members of the legal group experience a wide variety of interesting matters and frequent opportunities to learn and expand his or her skill set.

The position may be remote, but travel to San Diego, California and Oakland, New Jersey may be required from time-to time.  This job will report to the Deputy General Counsel.

What you’ll do:

  • Review, draft, and negotiate wide variety of commercial contracts, including manufacturing, supply, distribution, master service, software and data licensing, sponsored research, clinical trials, NDAs, etc.
  • Review and monitor promotional materials, activities, and business strategies
  • Implement and oversee Topcon’s healthcare compliance requirements in the US, including training and auditing business units on FDA regulations, Anti-Kickback statute, False Claims Act, and HIPAA and other privacy laws
  • Draft SOPs regarding risk mitigation, confidentiality, export control, and other business practices
  • Advise internal stakeholders across multiple business areas, including sales, marketing, research, regulatory, quality assurance, medical affairs, customer service, IT, and finance
  • Assist as needed with respect to intellectual property matters
  • Manage and advise on all aspects of litigation disputes and pre-litigation disputes
  • Supervise and partner with outside counsel to drive favorable outcomes in the above areas as needed
  • Sometimes travel to various business locations

Who we are looking for – someone with:

  • 3-5 years of relevant legal experience
  • Excellent oral and written communication skills
  • Experience drafting and negotiating commercial contracts and supporting transactions, particularly in the healthcare or medical device sectors
  • The ability to work collaboratively in a team environment with a wide variety of colleagues as well as external parties on a broad range of matters
  • The ability to manage and work with outside counsel and appropriately assess when consultation with outside counsel is appropriate
  • Entrepreneurial, enjoys working in a fast-paced environment and has the ability to work well independently and on a team and can manage and prioritize multiple tasks simultaneously.
  • Excellent judgment – ability to assess risks and benefits and determine best path to achieving the company’s goals
  • JD and state Bar admission in good standing

Base Pay:

Expected Base Pay Range: $130,000 to $150,000 Annualized

The base pay range included is a projected hiring range for a position, level and potential work location(s) listed.  Topcon provides the compensation range that it in good faith believes it might pay and/or offer for this position. This compensation range is based on a full-time schedule.   

Bonus eligible:

 In addition to base pay, compensation for this position includes eligibility for a 5% annual bonus.
